Copyright & DMCA Policy

Who owns content, and how to report infringement.

ConsuStay respects intellectual property and expects Users to do the same. This Policy explains who owns content, how to report infringement, and how we respond, including under the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

1. Ownership and license

Users keep ownership of the content they submit (User Content) and grant ConsuStay the license described in the Terms to operate and promote the Platform. The Platform itself — its software, design, trademarks, and other materials — is owned by or licensed to ConsuStay. Nothing here transfers ownership of the Platform to any User. This license does not purport to waive any moral rights (derechos morales) that cannot be waived under Applicable Law.

2. Your responsibilities

You may only upload content you own or have the necessary rights to use — including photographs, descriptions, logos, and any third-party material. You are responsible for having those rights.

3. Reporting copyright infringement (DMCA notice)

If you believe content on the Platform infringes your copyright, send a written notice to our Designated Agent (Section 4) that includes:

  • A physical or electronic signature of the owner or a person authorized to act for them;
  • Identification of the copyrighted work claimed to be infringed;
  • Identification of the material claimed to be infringing and enough information to locate it (e.g., a URL or Listing ID);
  • Your contact information (name, address, telephone, email);
  • A statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law;
  • A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner.

4. Designated Agent

5. What we do when we receive a notice

If a notice is valid, we may remove or disable access to the material and notify the User who posted it. We may also note the report for our repeat-infringer records.

6. Counter-notification

If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the Designated Agent that includes:

  • Your physical or electronic signature;
  • Identification of the material and its location before removal;
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification;
  • Your name, address, and telephone number, and consent to the jurisdiction of the appropriate U.S. federal court (or, if outside the U.S., a court where ConsuStay may be found), and that you will accept service from the complaining party.

If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the complaining party notifies us that it has filed a court action seeking to restrain the activity.

7. Repeat-infringer policy

We will, in appropriate circumstances, suspend or terminate the Accounts of Users who are repeat infringers.

8. Trademark and brand complaints

If you believe a Listing or User Content misuses your trademark, contact support@consustay.com with details of the mark, the alleged misuse, and your rights. Trademark complaints are handled separately from the DMCA process above.

9. Users in Mexico

Copyright and moral rights in Mexico are governed by the Federal Copyright Law and administered by INDAUTOR (and, for industrial property such as trademarks, IMPI). This Policy operates alongside those rights; it does not limit any right or remedy available under Mexican law.

10. False claims

Knowingly making a material misrepresentation in a takedown or counter-notice can create liability under 17 U.S.C. § 512(f). We may take action, including account suspension, against Users who abuse this process.
